Court Rejects 3-Strikes Term for Shoplifter In a 2-to-1 ruling, the panel of the United States Court of Appeals for the Ninth Circuit said the sentence of the shoplifter, Leonardo Andrade, violated the Bill of Rights' prohibition of cruel and unusual punishment. Mr. Andrade was sentenced to 50 years in prison for stealing nine videotapes, valued at $153, from a Kmart store.
